The Consumer Financial Protection Bureau has officially withdrawn a 2020 advisory opinion that outlined how for-profit companies could use Special Purpose Credit Programs, or SPCPs. The move reverses guidance issued in December of that year under the previous administration.
The original opinion had clarified that for-profit lenders could create SPCPs to serve specific underserved groups without violating fair lending laws. These programs are designed to expand access to credit for communities that have historically faced discrimination or lack adequate financial services. The 2020 guidance gave for-profit entities more flexibility to participate, going beyond the traditional scope of nonprofits and government agencies.
By rescinding that opinion, the CFPB signals a return to a narrower interpretation of the Equal Credit Opportunity Act. The bureau now says the earlier guidance may have been too permissive and could lead to unintended discrimination or confusion about legal requirements. Consumer advocates have long argued that allowing for-profit lenders to run targeted credit programs could weaken broader anti-discrimination protections.
Industry groups, however, expressed disappointment. They argue the rescission removes a useful tool for lenders trying to close racial and economic gaps in lending. Without clear federal guidance, some lenders may hesitate to launch or continue these programs, fearing legal risk.
The CFPB has not issued new guidance to replace the rescinded opinion. For now, for-profit lenders looking to run SPCPs must rely on older regulatory interpretations and case law. The bureau says it will continue to monitor the issue and may offer updated direction in the future.
